So what are the legal matters that concern flexible working and teleworking?

The thing to remember is that all your legal obligations regarding employees still apply.  This is whether they are in the office, remote working, mobile working or telecommuting.. Also, there are flexible working regulations giving certain employees a right to request flexible working. It is important for you to be aware of the right to flexible working, who this applies to and the process that must be adhered to.

Of course, you will need to be sure that your employees have a suitable working environment if they are working from home. Health and safety is a key issue. And there are other important issues regarding home working. Tax, for example, is a subject you need to be clear on.

The legislation that is in place that has particular relevance to teleworking and other flexible working practices includes:

  • Health and Safety at Work Act
  • The Data Protection Act
  • The Employment Equality Regulations
  • Employment Rights Act

There may also be issues relating to tax and insurance that will apply. So whilst you enjoy the many advantages of flexible working, including increasing productivity and an improvement in work life balance, make sure that all the legal aspects are covered.
